3. Purpose and Legal Basis for Processing
We process your personal data under specific, clearly defined legal bases pursuant to Article 6 of the GDPR:
- Handling B2B Inquiries & Commercial Proposals (Art. 6(1)(b) GDPR): Processing is necessary to take pre-contractual steps at your request prior to potentially entering into a commercial distribution or wholesale agreement.
- Legal Defense & Claims Retention (Art. 6(1)(f) GDPR): Processing and retaining business correspondence is necessary for our legitimate interests in establishing, exercising, or defending potential civil claims arising from commercial communications under Polish statutory limitation laws.
4. Data Retention Period
Personal data submitted via our B2B inquiry form is retained for the active duration required to evaluate, process, and respond to your commercial inquiry.
Upon conclusion of the business inquiry, data is archived for up to 3 years (calculated from the end of the calendar year in which communications ended), corresponding to the statutory limitation period for commercial claims under the Polish Civil Code (Kodeks Cywilny), after which it is securely deleted.
5. International Data Transfers (Formspree USA)
To securely transmit contact form submissions, we utilize the services of Formspree, Inc., located in the United States. Transmitting your form input involves an international data transfer outside the European Economic Area (EEA).
This transfer is safeguarded in compliance with GDPR Chapter V through:
- Standard Contractual Clauses (SCCs) approved by the European Commission pursuant to Art. 46(2)(c) GDPR executed with Formspree, Inc.
- Certification under the EU-U.S. Data Privacy Framework (DPF) ensuring an adequate level of data protection equivalent to EU standards.
